An Ikeja
Magistrates’ Court in Lagos, yesterday struck out a case of an applicant, Obed
Fwond, 32, charged with stabbing neighbour’s penis with a knife.
At the resumed
hearing, the prosecuting officer, Inspector George Nwosu, told the court that
Emeka Ofoke, the complainant had decided to withdraw the charge against the
accused.
Ruling on the
application of withdrawal, the Magistrate A.A Adesanya said: “the accused is
hereby discharged and acquitted.
“This follows
the application filed by the complainant notifying the court of his intention
to withdraw the charge.”
Obed, who
lives at Awori in Dopemu area of Agege, Lagos, was arraigned last November 24,
on a two-count charge of breach of peace and assault.
The prosecutor
had earlier told the court that the accused committed the offence on November
17 at his residence.
The accused
unlawfully assaulted Emeka Ofoke by stabbing him with a knife on his manhood.
The prosecutor
said Ofoke was coming back from work when he saw other tenants in the compound
gathering around Obed.
“The
complainant said he asked one of his neighbours what had happened and he was
told that Obed damaged the ceiling of the house to connect electricity supply
without informing others.
“Ofoke, who
confronted the accused on what he had done, told him it was only a thief that
would damage the ceiling of the house without informing other tenants.
“He said the
accused, who was annoyed about the statement, brought out a knife from his
pocket and stabbed his manhood with it.
“The
complainant said he was quickly rushed to the hospital by his neighbours who
were at the scene of the incident."
Now that the
case has been withdrawn, lets just hope that Emeka Ofoke's "thing" is
still working.
